1. This agreement
These terms are the agreement between you and The Lazy Hippo Development, a company registered in Seoul, Republic of Korea, for your use of the Tochi mobile app and this website (together, "Tochi" or "the Service").
By downloading, opening or using Tochi you accept these terms. If you do not accept them, please do not use Tochi.
Our Privacy Policy explains how we handle your personal data and forms part of this agreement.
2. What Tochi is — and is not
Tochi is a personal diary and mood tracking app with an animated companion. It lets you record how you feel, write about your days, hold conversations with Tochi, and collect what you have written into illustrated Life Chapters.
Tochi is not a medical device, a healthcare service, or a substitute for professional care. It does not diagnose, treat, cure or prevent any condition. Nothing Tochi generates is medical, psychological, legal or financial advice. If you are struggling, please contact a qualified professional or a local helpline — and if you are in immediate danger, contact your local emergency number.
Tochi's responses, Episode summaries, insights and chapter pages are produced by a language model working from what you wrote. They are interpretations and they can be mistaken, incomplete or unhelpful. You should not rely on them as statements of fact about yourself or anyone else. Everything Tochi has understood can be corrected or deleted by you at any time.
3. Who may use Tochi
You must be at least 16 if you are in the EEA or the UK, at least 14 in the Republic of Korea, and at least 13 elsewhere — or older where your local law requires it. If you are under the age of majority where you live, you may only use Tochi with the involvement of a parent or guardian.
You may not use Tochi if a sanction, export control or other law prohibits us from providing it to you.
4. Your account
You can start using Tochi without signing up. That creates an anonymous account tied to the installation, and you can link it to an email address, a Google account or an Apple ID later without losing what you wrote.
An anonymous account lives on that device and that installation only. If you delete the app or lose the device before linking it, your entries cannot be recovered — not by you and not by us. Linking an account is the only backup there is.
You are responsible for keeping your sign-in credentials secure and for what happens under your account. Tell us promptly if you believe someone else has access to it.
One person, one account. Do not share an account, sell it, or let anyone else use it.
5. Your content
You own it
Everything you write, log, record or upload in Tochi remains yours. We claim no ownership over any of it.
The permission you give us
To run the app at all, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, back up, transmit and display your content, and to process it — including by sending it to our language model provider as described in the Privacy Policy — solely in order to provide the Service to you.
This licence exists for no other purpose. It ends when you delete the content or your account, apart from copies in encrypted backups that expire on the schedule set out in the Privacy Policy. We do not use your diary content to train AI models, to advertise to you, or to show it to anyone else.
What you promise about it
You confirm that you have the right to write what you write, and that your content does not infringe anyone else's rights or break any law. Tochi is a private diary: you are responsible for what you choose to record about other people.
Getting it out
You can export Life Chapters as illustrated PDFs from inside the app, and you can request a copy of your personal data as described in the Privacy Policy.
6. Free use and subscriptions
What is always free
Downloading Tochi, logging moods and saving diary entries are free and not metered. We do not cap the habit itself.
The free weekly allowance
Features that call our language model are metered on a free account. A free account currently includes one conversation with Tochi and two deep logs per week. The allowance resets at the start of each ISO week (Monday). If a generation fails, the allowance is returned to you.
We may change these allowances. If we reduce them, we will tell you in the app first.
Tochi Premium
A paid subscription removes the weekly limits and unlocks the premium features described on the purchase screen at the time you buy. Current prices, periods and contents are always shown in the app before you confirm, in your own currency.
How billing works
- Purchases are made and charged through the Apple App Store or Google Play, not by us directly. Their terms govern the transaction.
- Subscriptions renew automatically for the same period at the then-current price unless cancelled at least 24 hours before the current period ends.
- Your account is charged for renewal within 24 hours of the end of the current period.
- Any free trial period is forfeited if you buy a subscription during it.
- We are told by the store whether your subscription is active. We never receive your card details.
Cancelling
Cancel at any time in your App Store or Google Play account settings — deleting the app does not cancel a subscription. Cancellation stops the next renewal; you keep premium access until the end of the period you already paid for.
7. Refunds and withdrawal
Because Apple and Google take the payment, refunds are handled by them under their own policies. Request one through the store you bought from. We will help where we can, but we cannot refund a transaction we did not process.
EU and UK consumers
You normally have 14 days to withdraw from a distance contract for digital content without giving a reason. By starting to use a premium feature immediately after purchase, you ask us to begin supplying the digital content during that period and you acknowledge that you lose the right of withdrawal once supply has begun. Where the right still applies, contact the store or write to us.
Korean consumers
Rights of subscription withdrawal and cancellation under the Act on the Consumer Protection in Electronic Commerce apply and are not limited by this section.
8. Acceptable use
Tochi is a private space, but it runs on shared infrastructure that costs money to operate. You agree not to:
- Use Tochi for anything unlawful, or to store content that is unlawful to possess
- Attempt to access another person's account or data
- Reverse engineer, decompile or extract the source of the app, except where that right cannot lawfully be restricted
- Automate, script or otherwise generate requests at a scale a person could not, or work around the free allowance or any other technical limit
- Resell, sublicense or commercially redistribute the Service or anything in it
- Interfere with the security or availability of the Service, or probe it without our written permission
- Use Tochi's outputs to build or train a competing model or dataset
If you break these rules we may limit, suspend or close your account. Where the breach is not serious and can be fixed, we will normally contact you first.
9. Our intellectual property
Tochi's name, the Tochi character, all illustrations and chapter artwork, the app's design, code, text and sounds belong to The Lazy Hippo Development or our licensors, and are protected by copyright and trade mark law.
We grant you a personal, non-transferable, non-exclusive, revocable licence to use the app on devices you own or control, for your own personal, non-commercial use, for as long as you comply with these terms.
You may share a chapter keepsake or an exported page that you generated from your own diary. You may not extract, redistribute or resell our artwork or other assets on their own.
10. Availability and changes
We work to keep Tochi running, but we do not promise that it will be uninterrupted or error-free. Maintenance, third-party outages and app store or operating system changes can all interrupt the Service.
We may add, change or remove features. If we remove something significant that you are paying for, we will give you reasonable notice in the app and, where appropriate, a pro-rata refund of the unused paid period.
We may update these terms. If a change is material we will notify you in the app before it takes effect. Continuing to use Tochi after that means you accept the updated terms; if you do not accept them, you may stop using Tochi and cancel your subscription.
11. Ending the agreement
You can stop at any time: delete your account inside the app, and cancel any subscription in the relevant store. Deleting your account removes your entries, your chapters and everything Tochi had understood, subject to the backup schedule in the Privacy Policy.
We may suspend or close your account if you materially breach these terms, if we are legally required to, or if we discontinue the Service entirely. Except where the breach makes it impossible, we will give you notice and a chance to export your chapters first.
12. Disclaimers and liability
To the fullest extent the law allows, Tochi is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.
We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of Tochi. Where we are liable, our total liability is limited to the greater of the amount you paid us in the twelve months before the event, or USD 50.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected, and if any provision here conflicts with mandatory consumer law in your country, that law wins.
You agree to indemnify us against claims brought by a third party that arise from your unlawful use of the Service or from content you stored in breach of section 5.
13. Governing law and disputes
These terms are governed by the laws of the Republic of Korea, and the Seoul Central District Court has jurisdiction.
If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, and you may also bring proceedings in the courts of that country.
Before starting formal proceedings, please write to us. Most problems are solved faster by email than by lawyers, and we would rather fix it.
Consumers in the EU may also use the European Commission's Online Dispute Resolution platform. Consumers in Korea may apply to the Korea Consumer Agency or the Electronic Commerce Mediation Committee.
14. General
- Severability. If a provision is found unenforceable, the rest stays in force and the provision is applied as closely as possible to its original intent.
- No waiver. If we do not enforce a right immediately, we have not given it up.
- Assignment. You may not transfer this agreement. We may transfer it as part of a merger, acquisition or sale of assets, on notice to you.
- Entire agreement. These terms and the Privacy Policy are the whole agreement between us about the Service.
- Language. These terms are published in English, 日本語, 한국어, 繁體中文, Deutsch, Français, Español and Português. The translations are provided for your convenience; if there is a conflict, the English version governs.
Apple App Store
If you obtained Tochi from the App Store: this agreement is between you and us, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
